Please read these Terms of Service ("Terms", "Agreement") carefully before using Simtegre eSIM mobile application and services ("Service") operated by Simtegre eSIM ("us", "we", "our", "Company").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Definitions
- "eSIM" means embedded Subscriber Identity Module, a digital SIM that allows activation of a cellular plan without a physical SIM card.
- "User" means any individual who accesses or uses the Service.
- "Data Plan" means the mobile data package purchased through the Service.
- "Activation" means the process of installing and enabling the eSIM profile on a compatible device.
- "Installation" means downloading and adding the eSIM profile to a device, regardless of whether it has been used.
2. Service Description
Simtegre eSIM provides digital eSIM services for mobile data connectivity. Our services include:
- Sale and delivery of eSIM data plans
- Digital delivery via QR code or activation code
- Usage monitoring and management tools
- Top-up services for eligible eSIMs
3. Eligibility
- You must be at least 18 years of age to use this Service
- You must have a compatible device that supports eSIM technology
- You must provide accurate, current, and complete information
- You are responsible for verifying device compatibility before purchase
4. Device Compatibility
⚠️ Important: Not all devices support eSIM technology. It is your responsibility to verify that your device is eSIM-compatible before making a purchase.
Common compatible devices include iPhone XS and newer, Samsung Galaxy S20 and newer, Google Pixel 3 and newer, and select other devices. Carrier-locked devices may not support eSIM.
We are not responsible for purchases made for incompatible devices. However, if you have not installed the eSIM, you may be eligible for a refund per our Refund Policy.
5. Account Registration
- You must provide a valid email address for account creation
- You are responsible for maintaining the confidentiality of your account
- You must notify us immediately of any unauthorized use
- One account per person; multiple accounts may be terminated
- We reserve the right to refuse service or terminate accounts at our discretion
6. Purchases and Payment
- All prices are displayed in USD unless otherwise specified
- Payment is due at the time of purchase
- We accept major credit/debit cards via secure payment processors (Stripe)
- All purchases are final, subject to our Refund Policy
- We reserve the right to modify prices at any time without prior notice
- Promotional offers and discounts are subject to specific terms and expiration dates
7. eSIM Delivery and Activation
- eSIM profiles are delivered digitally via QR code or activation code
- Delivery is immediate upon successful payment
- You are responsible for following the installation instructions provided
- Data plan validity begins upon first data usage or installation, as specified for each plan
- Unused validity periods cannot be paused, extended, or transferred
8. Refund Policy
✅ Refund Eligible
Uninstalled eSIM: Full refund within 90 days of purchase if:
- The eSIM has NOT been installed/activated on any device
- The eSIM QR code has NOT been scanned or activation code has NOT been used
- Your device is incompatible with eSIM (must not have attempted installation)
- You changed your travel plans and no longer need the eSIM
❌ Non-Refundable
Installed/Used eSIM: No refund will be provided if:
- The eSIM has been installed on any device (QR code scanned or activation code entered)
- Any data has been consumed from the plan
- The eSIM profile has been downloaded to the device, even if not actively used
- The validity period has expired
📋 Refund Process
- Contact support at support@simtegre.com with your order number
- We will verify the eSIM status (installation and usage history)
- If eligible, refund will be processed to the original payment method within 5-10 business days
- Refunds are issued in the original currency of purchase
9. Service Limitations
- Data Only: eSIM provides mobile data connectivity only. Voice calls and SMS are NOT included unless explicitly stated.
- Coverage: Coverage depends on local network partners and may vary by location
- Speed: Actual speeds depend on network conditions, congestion, and coverage area
- Fair Usage: Some plans may have fair usage policies or speed throttling after certain thresholds
- Tethering/Hotspot: May or may not be supported depending on the specific plan
10. Prohibited Uses
You agree NOT to use the Service for:
- Any unlawful purpose or illegal activities
- Commercial resale or redistribution without authorization
- Excessive bandwidth consumption or network abuse
- Circumventing geographical restrictions or content blocking
- Any activity that interferes with or disrupts the Service
- Violating any applicable local, national, or international law
- Transmitting viruses, malware, or harmful code
11. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Simtegre eSIM and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- Network coverage will be available in all locations
- Connection speeds will meet your expectations
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Simtegre eSIM shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for network outages, service interruptions, or issues caused by third-party carriers
- We are not liable for any loss of data, business, profits, or revenue
- Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim
- We are not responsible for device compatibility issues or user errors during installation
14. Indemnification
You agree to indemnify, defend, and hold harmless Simtegre eSIM, its officers, directors, employees, agents, and affiliates from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or transmit through the Service
15. Termination
- We may terminate or suspend your access immediately, without prior notice, for any breach of these Terms
- Upon termination, your right to use the Service will cease immediately
- Unused eSIM data will not be refunded upon termination for cause
- You may terminate your account at any time by contacting support
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in Istanbul, Turkey.
17. Dispute Resolution
In the event of any dispute, you agree to first attempt to resolve the dispute informally by contacting us. If informal resolution is unsuccessful within 30 days, either party may pursue formal legal remedies.
18. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
19. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Simtegre eSIM regarding the Service and supersede all prior agreements and understandings.
